This Privacy Policy explains how Yarra International Co., Inc. (“Yarra”, “Yarra.ph”, “we”, “our” or “us”) and our affiliates collect, use, and disclose the personal information of users of our websites, mobile applications, and other products and services (collectively, “Services”). By using our Services, you agree to the terms of this Privacy Policy.

If you do not agree with the terms of this Privacy Policy, please do not use our Services.

2. Who Controls Your Data

Yarra is a licensed international recruitment agency based in the Philippines and controls the data collected and processed through our Services. In certain instances, YARRA acts as a data processor for our clients, who act as data controllers, and processes personal information under their direction.

3. Types of Data We Collect

Based on your engagement with our services whether you are a Job Seeker or an Employer. We collect and process two types of information about you, including:

  • Personal Data: This is information that identifies you as an individual or can be used to identify you, such as your name, contact information, profile information, job application information, and technical and usage information about the devices you use to access our Services.

  • Non-Personal Data: This is information that is non-identifying and cannot be used to identify you, such as statistics or aggregated information. In the event we combine personal data with non-personal data, the combined information will be treated as personal data for as long as it remains combined.

We do not require Sensitive Personal Data from you to use our Services. This type of information includes things like information about your race or ethnicity, political views, religion, philosophical beliefs, union membership, genetic and biometric data, and information about your health, sexual life or orientation. If you are a Job Seeker using our Services, please consider the information you share and make sure not to include any Sensitive Personal Data or other unnecessary information in your job application or job search. While you are not legally required to provide us with any information, please note that choosing not to provide certain Personal Data may prevent us from offering certain Services to you.

4. How We Use Your Personal & Non- Personal Data
Personal Data collected from Employers

As an Employer using our Services, you may share your Personal Data such as your name, contact information, profile information, transaction and financial information with us in various ways, such as:

  • creating an employer account
  • posting or distributing job advertisements through our Services
  • opting in to receive newsletters or other communications about new or existing features
  • requesting information to be sent to you
  • using our customer service or support, or making technical requests
  • providing feedback or participating in surveys
  • communicating with us regarding any transactional or other matters.

In those instances, we use your Personal Data for our legitimate interest and to fulfill the Services you have requested or to respond to your inquiries and provide you with the support or information you have requested. Your calls may be recorded and analyzed for training, quality control, and sales and marketing purposes when you communicate with us over the phone. We will notify you of the recording through either a voice prompt or script. When participating in a survey, we collect information you provide through it. If the survey is provided by a third-party service provider, the third party’s privacy policy applies to the collection, use, and disclosure of your information. Participation in any such surveys is completely voluntary and you have the choice to disclose such information or not.

Personal Data collected from Job Seekers

As a Job Seeker using our Services, you may share your Personal Data such as your name, contact information, profile information, and application details such as:

  • creating a Job-Seeker account
  • signing up for job alerts
  • applying for a job posting on our Website, mobile app, or through third-party sponsored ads
  • using our customer service or support, or making technical requests
  • providing feedback or participating in surveys.

In those instances, we use your Personal Data for our legitimate interests and to perform the Services you have requested or to respond to your inquiries and provide you with the support or information you have asked for. For example, when you subscribe to our email alerts, we use your email (based on your consent) to send you personalized and relevant job listings related to your job search. You may manage your alerts or unsubscribe at any time.

When you apply for a job using our Website, we gather your Application Data with your consent to send it to the employer whose job posting you responded to. This information is then linked to your Job Seeker account, allowing you to easily apply for future positions without having to re-enter your application details. In some cases, when you apply for a job, you may be directed to the employer’s website or application tracking system, in which case we do not collect your Application Data, but process it on behalf of the employer.

Personal and Non-Personal Data automatically collected from you

We may automatically collect certain technical information from your device as you interact with our Website or use our mobile application. This may include details such as your IP address, device information, login data, browsing patterns, and information about how you interact with our Services, such as the links you click on or forms you fill out. Additionally, when you receive an email from us, we may use tools to track data such as when you open the message, click on links, and subscribe to our Services. This information is referred to as “Technical Data” and “Usage Data.”

We gather Technical and Usage Data through the use of cookies, pixels, server logs, and other technologies of a similar nature. These “cookies” are small pieces of information that are sent to your computer’s hard drive while you are viewing a website. Additionally, we may also collect Technical Data and Usage Data about you when you visit other websites that use our cookies and similar technologies, such as third-party websites where we post job advertisements. Our Cookie Policy has more information on this topic.

We collect Technical Data and Usage Data to optimize the performance and functionality of our Website and mobile applications, to enhance the user experience, to detect and prevent fraudulent activities, to tailor our services to meet your needs and to gather insights on the popularity of our Services.

Personal Data we receive from third parties

We may receive Personal Data in the form of Technical Data and Usage Data from third-party sources such as analytics providers. Additionally, we may engage in behavior-based advertising, where a third party uses technology, such as cookies, to gather information about your use of our Website to display targeted advertisements for products and services that align with your interests on our Website or other websites. However, we will only deploy these non-essential third-party cookies after obtaining your explicit consent through a separate opt-in mechanism.

When you use third-party websites such as Facebook, or Google to access your Yarra.ph account, this creates a Yarra.ph account using the same email address used in your Social Media account. By providing this information to Yarra.ph, your Social Media account will verify your identity and redirect you to Yarra.ph. Keep in mind that when logging into Yarra.ph using your Social Media account, these websites will use cookies to identify you as a Social Media user.

By logging into Yarra.ph using your Social Media account, you are allowing the Social Media providers to share certain information with us for the purpose of authentication and secure access to our website. You can stop this at any time by modifying your settings on your Social Media account. The information shared will be considered as part of your Yarra.ph account information for the purpose of using our Services.

When Yarra acts as a data processor

If Yarra is handling your Personal Data as a data processor, and you want to access, correct, delete, or have any other requests related to your data, we will provide you with the contact information of the data controller so you can reach out to them directly. In some cases, Yarra may need to assist you with your inquiry or request.

As a data processor, we retain Personal Data only for the duration needed to fulfill our obligations to the data controller client, or as per their instructions, or as required by law.

5. Sharing of Personal and Non-Personal Data

In addition to the specific situations outlined elsewhere in this Privacy Policy, we may share Personal Data in the following scenarios:

  • Job Seekers and Employers. When a Job Seeker applies for a job post via our website, we share their Application Data with the Employer. This can include sharing the Application Data with the employer looking to hire, the agency recruiting on behalf of the Employer, or external systems such as applicant tracking systems used by the employer or agency to manage the hiring process. Employers who use our services are required to comply with all data protection laws and regulations related to the collection, processing, and storage of Personal Data, as well as providing adequate protection of all data subject rights provided for under all applicable data protection laws. When an employer uses our services, we may share employer-related information with job seekers, such as job advertisements, company pages, and salary information on our website. This information may also be shared on third-party websites.

  • Other disclosures with your consent. We may ask if you would like us to share your information with other unaffiliated third parties who are not described elsewhere in this Privacy Policy.

  • Other disclosures without your consent. We may reveal information in accordance with legal requests such as subpoenas, warrants, or court orders, or in relation to any legal proceedings. Additionally, we may share your information to assert or enforce our rights, to defend against legal claims, to investigate potential illegal activities, suspected fraud, safety concerns, or violations of our policies, or to comply with requests for products or services from a third-party intermediary.

Unless otherwise stated in this Privacy Notice, we do not sell, trade, rent, or share your Personal Data for marketing purposes without your consent. We may use or disclose Non-Personal Data in any of the circumstances outlined above, as well as for the purpose of providing and improving our Service and for commercial use.

6. Personal Data Retention

The duration for which we retain Personal Data depends on the reasons for which it was collected and used, as well as any legal requirements. In cases where deletion or anonymization is not possible due to technical limitations, we secure Personal Data and restrict its active use. See Section 8 of this policy about how we store your Personal Data.

7. Personal Data Protection

We have implemented security measures to protect your Personal Data from unauthorized access. These measures take into consideration the level of sensitivity of the Personal Data we collect, use, and store, as well as the current state of technology. To minimize the risk of data loss, misuse, unauthorized access, and unauthorized disclosure and alteration, we use both technical and organizational security measures. We regularly review our practices for collecting, storing, and processing practices, including security measures, to prevent unauthorized access to our systems. Your account is protected by a password, and it is important to keep your Personal Data safe by not sharing your password and by logging out of your account after each use.

We cannot guarantee the complete security of any information you transmit to us. The internet is not a completely secure environment, and there is a risk that information on the Website may be accessed, disclosed, altered, or destroyed by a breach of our physical, technical, and/or managerial safeguards.
